The House Can Wait: 7 Things Katy Families Should Know After Losing a Loved One

When someone you love passes away, the last thing you should be thinking about is a mortgage statement or a stack of paperwork. And yet the house is often the biggest thing they leave behind, and it has a way of pulling the whole family’s attention whether you are ready for it or not.

I have guided a lot of Katy families through this exact season, the one nobody feels prepared for. Death is the hardest of what I call the Big Ds in real estate: death, divorce, and downsizing. And the house is rarely the real story. The real story is the people, the memories, and figuring out what comes next without anyone feeling rushed or railroaded.

So before you make a single decision about the house, here are seven things worth knowing. Take them slowly. There is no prize for hurrying.

1. Give yourself permission to slow down.

The house is not going anywhere. In most cases there is no clock ticking the way people fear there is. Grief does not keep a tidy schedule, and neither should the decisions about a home. Give the family room to breathe first. The paperwork will still be there next week, and next month.

2. Find the will and the important papers before anything gets moved.

Before drawers get emptied or a single box gets hauled off, locate the will, the deed, insurance policies, and any trust documents. These often live in a home safe, a filing cabinet, or a safe deposit box. They shape everything that follows, and they are far harder to track down once the house has been cleared out. If you are not sure what you are looking at, that is normal. A good estate attorney can help you make sense of it.

3. Find out who has the authority to sell, because it may be no one yet.

This surprises families every time. If the home was in your loved one’s name alone, then until the estate goes through the proper legal process, no one has the authority to sell it, not even the person named in the will. Depending on the situation, that might mean full probate, or it might mean a simpler path like a muniment of title. :The big exception is a trust. If the home was already held in one, the trustee can usually act without waiting on the courts. Which road applies to you is a question for an estate attorney, and it is worth asking early so you know what you are working with.

4. Keep the house protected in the meantime.

An empty house is a vulnerable house. Keep the insurance active, and ask your carrier about vacant home coverage, because a standard policy can quietly stop covering a home once no one is living in it. Keep the utilities on so the pipes and air stay healthy, keep the lawn up so the property does not signal “empty” to the wrong people, and if the home sits in one of Katy’s master-planned communities, keep the HOA dues current so fees and violations do not pile up. These are small things that get expensive fast when they are missed.

5. Be careful with the offers that show up in the mailbox.

Within weeks of a passing, the “we buy houses for cash” letters and calls tend to start. Some are legitimate. Many are betting on a grieving family being tired enough to take the first number offered, which is almost never the best one. Please do not sign anything under pressure. There is no offer so good that it cannot wait for you to have someone in your corner look at it first.

6. Know that you have more than one option.

Once the legal authority is sorted out, selling is not your only path. You can keep the home in the family, you can hold it and rent it out for income, or you can sell it and split the proceeds. Each option carries different tax and financial angles, and the right answer depends on the family, not on whatever is easiest for someone else. 7. Lean on someone who has walked this road before.

You do not have to figure this out alone, and you should not have to lift the heavy things yourself.
